Minimum Requirements for Car Insurance in Massachusetts

  • Massachusetts requires all vehicles to be covered by liability insurance, personal injury protection and uninsured motorist insurance.
  • Liability Coverage minimums:
    • $20,000 per single bodily injury or death.
    • $40,000 per multiple bodily injuries or deaths.
    • $5,000 for property damage.
  • Personal Injury Protection minimums:
    • $8,000 per person for medical coverage
  • Uninsured Motorist minimums:
    • $20,000 per person
    • $40,000 per accident

New Driver Licensing Requirements:

  • Massachusetts’s Registry of Motor Vehicles provides information for new drivers applying for a state drivers license, and Massachusetts employs a Junior Operator’s License (JOL) program to allow new drivers to practice driving prior to applying for a full license.
  • Learner’s Permit. Applicants 16 years of age or older may begin the process at this stage with their parent’s/legal guardian’s consent. The applicant must pass the vision test and the written test, and while holding the Learner’s Permit, the following applies:
    • The applicant must be accompanied by a licensed driver age 21 or older who has held a license for 1 year.
    • If under 18, the applicant may drive between the hours of 12 am and 5 am.
    • The applicant must complete 40 hours of driving time and submit a driver’s time log.
    • The applicant must complete an approved driver education program which includes 30 hours of classroom, 12 hours of driving training, 6 hours of in-car observation of another student driver and 2 hours of class attendance by the applicant’s parent/legal guardian.
    • The applicant must hold the license for 6 months prior to applying for the Junior Operator’s License.
  • Junior Operator License (JOL). To hold a JOL, the applicant:
    • Must be at least 16 years, 6 months of age
    • Must have completed a driver education course
    • Must submit a completed supervised driving log containing an additional 40 hours of supervised driving
    • Must have a valid Massachusetts Learner’s Permit which he/she has held for at least 6 months
    • Must have a clean driving record
    • For the first 6 months, the applicant may not drive with any passenger under 18 years of age unless he/she is also accompanied by a licensed driver age 21 or older.
    • The applicant may not drive between the hours of 12:30 am and 5 am.
    • Must pass the road skills test
  • Driver’s License. To hold a drivers license, the applicant:
    • Must be at least 18 years of age
    • Must have held a provisional license for 18 months with no violations
  • Vision Exam. Applicants will be screened for visual acuity, color vision and peripheral vision. Passing standards require a visual acuity of 20/40 and 120 degrees of peripheral vision. If the applicant’s acuity falls between 20/50 and 20/70, a daylight driving restriction may be applied.
  • Knowledge Test. Applicants must pass a 25-question knowledge test that evaluates his/her understanding of basic traffic laws, regulations, signs and signals. The Massachusetts Driver’s Manual covers all the necessary information to pass the test.
  • Road Skills Test. This test is designed to evaluate the applicant’s ability to maneuver his/her vehicle safely and legally. The vehicle, provided by the applicant, will undergo a pre-test check with the test administrator. The requirements for the check can be found in the Massachusetts Driver’s Manual. The following skills will be evaluated by the test administrator:
    • Use of hand signals
    • Starting and stopping the vehicle
    • Parallel parking
    • Backing the vehicle 50 feet
    • Making left and right turns
    • Grade parking, stopping, starting
    • Three point turn
    • Entering and leaving intersections
    • Obey traffic signs, signals and markings
    • Lane control
    • Posture and hand position
    • Right-of-way
  • Fees. The following fees apply for every applicant:
    • Learner’s Permit: $30
    • Road test: $20
    • New Drivers License: $50

DUI/DWI Laws

  • BAC limit: .08 Massachusetts’ Department of Transportation has produced a helpful brochure outlining the state’s Operating Under the Influence (OUI) laws. The brochure can be accessed at the Massachusetts’ DOT website.
  • The BAC limit for drivers under 21 is .02. Upon failing a breath test, the driver’s license will be automatically suspended for 30 days, and the driver’s vehicle will be impounded.
  • Listed below are the major penalties for OUI convictions in Massachusetts:

    • Fine: $500 – $5,000
    • Jail: maximum 18 months
    • License suspension: 1 year
  • Second Offense:
    • Fine: $600 – $10,000
    • Jail: 30 days to 18 months
    • License suspension: 2 years
    • Possible Ignition Interlock extending 2 years after the reinstatement date
  • Third Offense:
    • Fine: $1,000 – $15,000
    • Jail: 150 days to 5 years
    • License suspension: 8 years
    • Possible Ignition Interlock extending 2 years after the reinstatement date
  • Refusal to submit to an alcohol test results in the following license suspension(s):
    • No prior convictions: 180 days
    • 1 prior conviction: 3 years
    • 2 prior convictions: 5 years
    • 3 or more prior convictions: lifetime suspension
  • Ignition Interlock Devices require a fee of $100 to $500 for installation and a monthly premium of at least $85.

Texting & Driving Laws

Massachusetts, according to Distraction.gov, has banned cell phone use from novice drivers and bus drivers. The state has also banned texting from all drivers.

Unique Laws
