A new and more stringent child car seat law went into effect in 2017 in New Jersey, requiring children under age 2 or under 30 pounds to ride in a rear-facing car seat with a five-point harness. Children up to age 8 or who weigh under 80 pounds must ride in an approved safety or booster seat located in the rear seat. The new law also raised fines for drivers with children in inappropriate seats or booster seats. State laws still do not specify when a child over 8 can move from the back seat to the front seat.

Drivers and all passengers must wear seat belts, according to the State of New Jersey Motor Vehicle Commission. Handheld drives are banned statewide while driving, and New Jersey in 2014 increased the fines for anyone caught talking and texting on a handheld device while behind the wheel.

New Jersey drivers with a blood alcohol concentration of .08 percent or higher are charged with DUI. Charges are enhanced when the BAC is .10 or greater. First offenders face a $250 to $400 fine, up to 30 days in jail and installation of interlock devices and community service.
