All front seat occupants and everyone in the car under 18 must wear seat belts.

Drivers with a BAC of .08 are charged with DUI in North Dakota, and those under 21 are charged with a BAC of .02. A first offense with a BAC level below .16 results in license suspension up to 91 days, while a first-time conviction with a BAC of .16 or more results in a 180-day suspension. In addition are fines of up to $750 and addiction evaluation. Second offenders receive 10 days in jail and a $1,500 fine, up to two years license suspension and must participate in the “24/7” sobriety program.
