Seat Belt Law

In Hawaii,

all front-seat and back-seat occupants in a vehicle must wear seat belts, according to the state Department of Transportation. In addition, children under 4 must ride in a child safety seat, and children between 4 and 8 must ride in either a child safety seat or a booster seat. Violators must attend a four-hour class and may be fined $100 to $500.

Distracted Driving Law

State law prohibits the use of handheld mobile electronic devices while driving, as well as when a vehicle is at a stoplight or stop sign, according to the state Department of Transportation. Additionally, a driver under 18 cannot use a hands-free mobile electronic device. Fines start at $257.

Helmet Law

Motorcycle operators and passengers under age 18 must wear a helmet; operators and passengers 18 and over aren’t required to wear a helmet. 

All children under 16 must wear a helmet when cycling.

Impaired Driving Law

In Hawaii, a driver 21 and over is classified as drunk (sometimes known as operating a vehicle under the influence of an intoxicant, or OVUII) if he or she has a blood alcohol concentration (BAC) of at least 0.08 percent. The BAC limit drops to 0.04 percent for drivers of commercial vehicles and to zero percent for drivers under 21. 

A first-time DUI offender faces a jail sentence of 48 hours to five days, a fine of $150 to $1,000, and 72 hours of community service. In addition, the offender’s license is suspended for 90 days. Also, a first-time offender must go through a 14-hour substance abuse rehab program and pay a $25 surcharge.
