Here are provisions of the law that apply to child passengers, according to the Missouri Department of Transportation

  • Children under 4 or under 40 pounds must be in a child safety seat.
  • Children 4 to 7 who weigh at least 40 pounds must be in a child safety seat or booster seat until reaching 80 pounds or 4 feet, 9 inches in height.
  • Children 8 and over or who weigh at least 80 pounds or are at least 4 feet, 9 inches tall must be secured by a safety belt or be buckled into a booster seat. 

The fine for violating the child safety rules is $50 plus court costs.

Distracted Driving Law

Drivers 21 and under as well as commercial drivers are prohibited from texting while driving in Missouri. Otherwise, the use of cellphones and other electronic devices while driving is not banned.

Helmet Law

In Missouri, all motorcycle operators and passengers must wear a helmet. Violating the law can lead to a $25 fine. Neither the state nor the City of Kansas City requires bicyclists to wear helmets.

Impaired Driving Law

The blood alcohol concentration (BAC) that triggers a DWI in Missouri varies. It’s 0.08 percent for drivers overall, but 0.04 percent for commercial drivers and 0.02 percent for drivers under 21. 

A first-time DWI offender faces up to six months in jail, up to a $500 fine, a 90-day license suspension/restriction and possible installation of an interlock ignition device.
