Seat Belt Law

Anyone age 16 or above who’s driving or riding in a vehicle must wear a seat belt, and a driver must ensure that all children under age 16 either are wearing a seat belt or are in an approved child restraint device.

Children under age 8, unless the child is at least 4 feet, 9 inches tall, must be in a car seat or booster seat. After reaching that age or height, a child must use a seat belt correctly or must keep using a car seat or booster seat. Children under age 13 must sit in the back seat when it’s practical.

Cellphone Law

Nonemergency use of a handheld electronic device is illegal while driving a car — even if the car is stopped at an intersection or in traffic — and can lead to a $136 traffic ticket, according to the Seattle Times. Devices must be mounted in a cradle or be built in, and must require “minimal use of a finger” to open the app, the Times says. Watching any video is illegal.

Helmet Law

In Washington, all motorcycle operators and passengers must wear a helmet, according to the Washington State Patrol. In King County, which includes Seattle, all bicyclists must wear a helmet.

Impaired Driving Law

In Washington, a driver 21 and over can be charged with DUI with a blood alcohol content (BAC) of 0.08 percent or more. For a driver under 21, the BAC limit is 0.02 percent.

If you’re arrested for DUI, your driver’s license can be suspended for 90 days to two years. If you’re convicted of DUI, your license can be suspended for 90 days to four years. If convicted of DUI for the first time (with a BAC less than 0.15 percent), you can be sentenced to anywhere from one day to 364 days in jail, and be fined $940 to $5,000. Also, you may be required to install an ignition interlock device and to get an S-22 insurance form.

A commercial driver who has more than one DUI will have their commercial driving privileges permanently suspended.
