Drivers with a blood alcohol concentration of .08 percent or higher are charged with driving under the influence, according to the Pennsylvania Department of Motor Vehicles. A BAC of .10 or higher is an enhanced charge, as is a DUI by a minor, commercial driver or a driver in an accident causing injury or damage. First offenders face up to six months of probation, $300 fine, alcohol highway safety school and treatment if ordered.
